One instance where the death penalty was said to kill an innocent person was the controversial story of Troy Davis, in which a Black male by the name of Troy Davis was said to be wrongly accused of committing  a murder. Substantial evidence was brought up after the trail which could have proven that Troy Davis was falsely accused falsely convicted and truly innocent, but instead of reviewing this evidence  the Georgia Board of Paroles and Pardons refused to grant him clemency and as a result he died by lethal injection on September 21, 2011 . &amp;#8220;&lt;span&gt;Troy Davis was executed this evening for the murder of an off-duty policeman after the U.S. Supreme Court denied a last-minute stay of execution amid widespread public doubts about his guilt.&lt;/span&gt;&lt;span&gt;Davis, 42, died at 11:08 p.m. ET, according to a Georgia Department of Corrections official. Most of them are at the hands of jury and a judge that may find them eligible and obligated to feel the full extent of the law by sentencing them to death, not because their crime was extremely heinous but because the color of their skin and in other cases their inability to pay for the necessary legal defense and this all results into the death of the accused. The people that are without the funds to hire adequate legal council are forced to settle for council provided by the state and in most times the legal council provided by the state isn&amp;#8217;t necessarily the most desirable legal council especially in a case that may have an individuals life on the line. If the individual were to be convicted of a crime the resulted in him receiving the death penalty this alone could be seen as an injustice and a form of discrimination that has disadvantaged the individual all just because he/she could not receive proper representation. &amp;#8220;because adequate investigation and good legal counsel come very,very high. but it is all completely out of reach of the poor. The poor man unless some public interest organization happens to see an important issue in his case can no more afford a really adequate defense than he can afford a year&amp;#8217;s cruise around the wold on a a luxury liner. A study was done in the United States in which the death penalty and the amount of homicides in the a total of 48 states were collected starting from the year 1970 to the year 1995. It was concluded that &amp;#8220;States with the death penalty have higher murder rates than non-death-penalty state. &lt;p&gt;   Capital Punishment has been a practice that has existed since the dawn of modern civilization.The practice has been implemented in a multitude of societies and cultures for many centuries as a tool to punish those that have sinned,disobeyed,deviated, and dishonored in a society in order to bring about justice. It is also seen as a tool that brings justice rather swiftly some would argue too swiftly.Many have been chosen to face capital punishment without the usage of judicial due process in which no trail is given and the fate of an individuals life is held by the executioner. Till this day capital punishment is held responsible for the extensive amount of casualties. Some being recorded from the 17th century during in the sprawl of the french revolution capital punishment was used excessively in which the usage guillotine was very popular, many fell victim to its swift blade and many doing so without due process.During the Middle Ages the implementation of the Breaking Wheel was also used in which the executioner would use a large wooden wheel and break various bones in the convicted individuals body there were so many intricate ways to engage in torturer the individual, that special instructions were given in ways to torture the person. Some would find a grim joy in doing this that some would keep the convict alive for hours and even days as the executioner chose to do their worst. It is also very apparent that the death penalty has been well justified in its usage against those that have committed absolute &lt;span&gt;heinous and as some would say unforgivable crimes, some even go on to say that the death penalty alone shouldnt be used but  that the individual deserves to suffer further than a simple execution. Through the progression of time capital punishment has been perceived to be less &lt;/span&gt;&lt;span&gt;severe and today has been relatively painless process if  and when administered by a proper judicial system. The underlying question that remains is if the death penalty should still be used even though it can and has been used unfairly as well as it being a tool that has made victims of innocent.&lt;/span&gt;&lt;/p&gt;
